Unnamed NE Tributary of Butler Creek [S-3271] is one of 3 sites monitored by Group [ G-1923] Ridgecrest Dr @ NE Butler Creek Tributary


Site Description: The location of this monitoring site is approximately 3,600 feet downstream of the future Camp McDonald Park. The future park consists of 7 ½ acres of wooded land and is located across from Kennesaw's City Hall near the intersection of Watts Drive and Main Street. The future park is adjacent to historic natural springs and appears to be the headwaters of this particular tributary of Butler Creek, and is of cultural and historical significance. Approximately 2,000 feet south of the future park and approximately 1,500 feet north of the monitoring site is an area of commercial development including a gasoline station, auto parts store, and fast food restaurant. A detention pond is situated just south of the gasoline station. In this beginning stage of monitoring it is unknown whether a significant nexus exists between the detention pond and the jurisdictional waters of Butler Creek. A significant nexus exists when it can be demonstrated that the tributary and/or wetland along with any similarly situated wetlands has “more than a speculative or insubstantial effect on the chemical, physical and biological integrity of a traditional navigable water” (Appendix A, Memorandum Re: Jurisdiction Following The U.S. Supreme Court Decision In Rapanos v. United States, June 5, 2007, page 10).
